BANK FROM ANY CORNER CONTEST

NO PURCHASE OR TRANSACTION NECESSARY TO PARTICIPATE.

  1. HOW TO PLAY: The Bank from any Corner Contest (the “Contest”) is sponsored by ING Bank, fsb (“ING DIRECT”) and begins on July 28, 2010 at 12:01 a.m. Eastern Time (“(ET)”) and ends at 11:59 p.m. (ET) on August 28, 2010 (the “Contest Period”).

    To play, during the Contest Period you must submit a video or photograph (both a video or photo can be submitted online, only a photo on a mobile device) showing us the coolest/craziest place that you can bank using ING DIRECT’s new mobile app. Please see the entry Guidelines below – if your entry violates the Guidelines, your entry will be disqualified and won’t be judged. There are three ways to enter the Contest: 1) Go to http://www.ingdirectmobilecontest.com from your computer, complete the entry form in its entirety, upload your video or photo, check the box that you have read and agree to these Official Rules, and submit; 2) Go to http://www.ingdirectmobilecontest.com from your mobile device (internet access on your mobile device will be required), complete the entry form in its entirety, check the box that you have read and agree to these Official Rules, submit, and follow the instructions to email your photo (only accepts photos from a mobile device) using the email address you provided on the entry form. Failure to exactly match the email address you provided on the entry form will result in an incomplete and ineligible entry; 3) Visit http://www.facebook.com/ingdirect, go to the Mobile Contest tab on the ING DIRECT Facebook page, click the “enter now” button and it will direct you to the online entry form at www.ingdirectmobilecontest.com. Complete the entry form in its entirety, upload your video or photo, check the box that you have read and agree to these Official Rules, and submit.

    Each entry will be reviewed by a panel of judges (the “Judges”) and assigned a composite score by the Judges based upon the following weighted criteria: originality and creativity (50%); quality of production (25%) and clarity of presentation (25%). Prizes will be awarded to the entrants whose entries received the twenty (20) highest composite scores. The decisions of ING DIRECT and/or its agents (including, without limitation, the Judges) are final on all matters relating to the Contest. The general public will be able to view all entries and rate them. Votes received from these public ratings will not have any bearing on the final determination of the winners.

    Only one entry per person permitted during the Contest Period. Multiple entries are void and if more than one entry is submitted by any person, only the first entry submitted by that person will be judged. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail account used to submit the entry is registered. All entries are the property of ING DIRECT and will not be acknowledged or returned. ING DIRECT has no responsibility for deleted, undelivered, lost, illegible, incomplete, misdirected, late, altered, forged, or otherwise defective entries.

  2. PRIZES: One (1) grand prize will be awarded to the entrant whose entry received the highest composite score. The grand prize winner will receive $10,000.00 to be deposited in the winner’s Orange Savings Account™.

    One (1) first prize will be awarded to the entrant whose entry received the second highest composite score. The first prize winner will receive $5,000.00 to be deposited in the winner’s Orange Savings Account™.

    One (1) second prize will be awarded to the entrant whose entry received the third highest composite score. The second prize winner will receive $2,500.00 to be deposited in the winner’s Orange Savings Account™.

    Twelve (12) third prizes will be awarded to each of the entrants whose entry received the fourth to fifteenth highest composite scores. Each third prize winner will receive an iPod Touch (32GB). The Approximate Retail Value (the “ARV”) of the third prize is $299.00 each. Total ARV is $3,588.00

    In addition to the above prizes, one (1) weekly prize of an iPod Touch with and ARV of $299.00 each will be awarded for each of the five weeks during the Contest Period. Each weekly prize will be awarded to the entrant whose entry received the highest composite score from among all eligible entries received for each week during the Contest Period, based on the weekly entry and winner determination schedule below:

    The TOTAL ARV of the weekly prize is $1,495.00.

    Total ARV of all prizes available to be won is $22,583.00.

    Each prize winner will be notified by e-mail, telephone, U.S. mail and/or express mail service. Return of a prize or any notification as undeliverable may result in disqualification and alternate selection. Prizes can’t be substituted, transferred, or exchanged. Prize winners will be required to sign an Affidavit of Eligibility and Release, to be returned within the time specified or the prize winner will be disqualified, her/his prize will be void and another prize winner will be selected. Each grand prize, first prize and second prize winner who does not have an Orange Savings Account™ must also complete any additional documentation required to open one within 30 days of the prize notification.

  3. ENTRY GUIDELINES: Your entry cannot contain any offensive material, threats or defamatory statements (including, without limitation, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group), or display any commercial/corporate advertising or logos other than those of ING DIRECT. Your entry must meet the following technical requirements:

    Videos:
    • Your video should be between 15 seconds to 60 seconds in length.
    • The video file cannot exceed 20MB.
    • Acceptable file formats are: avi, mov, mpg, or wmv.
    Photos:
    • The photo file cannot exceed 2MB.
    • Acceptable file formats are: jpg or gif.

    Your entry must be created by or on behalf of you. By participating in the Contest, you represent and warrant that your entry is original and previously unpublished, hasn’t been created by a professional videographer or photographer, and doesn’t violate the privacy rights of any person or any other third party rights (including, without limitation, copyright or other proprietary rights). You must appear in your entry. If your entry contains any person other than you, you agree to receive permission from each other person featured in the entry (or from the parent/legal guardian if other person is a minor). You agree to indemnify and hold harmless ING DIRECT from any copyright, trademark or other intellectual property infringement claim or liability with regard to your entry. Each prize winner grants ING DIRECT a perpetual, irrevocable, fully-paid, royalty-free, transferable, non-exclusive, world-wide right and license in and to his/her entry, with rights to sublicense, to use, copy, modify, reproduce, market, publish, distribute, sell and otherwise exploit for any purpose whatsoever, including without limitation, modifying the entry, copying the entry, improving the entry, making derivative works thereto, reproducing the entry and distributing the entry.

  4. GENERAL CONDITIONS: Open to all legal U.S. residents, 18 years of age or older as of the date of entry, except: employees, agents and directors of Facebook, Inc., ING DIRECT, as well as its distributing, advertising and promotional agencies, and immediate family members (defined as spouses, children, parents, siblings and in-laws) and persons living in the same household as such individuals, are not eligible to participate or win. Void where prohibited and subject to all federal, state and local laws. Each prize winner’s tax liability, if any, is the sole responsibility of the prize winner.

    Each entrant (including, without limitation, the prize winners) grants ING DIRECT, its parents, subsidiaries, affiliates, distributors, agents (including, without limitation, the Judges), advertising and promotion agencies, licensees, assigns and suppliers, and all of their respective directors, officers, employees, representatives, and agents the absolute right and permission to use his/her entry, name, address (city and state), photograph, likeness, biographical information, statement and voice (including, without limitation, any audio or video of him/her) in perpetuity for trade, advertising, promotional, publicity and/or any other purposes worldwide in all forms of media now or hereafter known (including, without limitation, print, broadcast and Internet) without future notice or compensation, except where prohibited by law. Each entrant (including, without limitation, the prize winners) acknowledges that she/he shall have no right of approval and no claim arising out of the use, alteration, distortion or illusionary effect or use in any composite form of her/his entry, name, address, photograph, likeness, biographical information, statement and voice (including, without limitation, any audio or video of her/him). Each entrant (including, without limitation, the prize winners) agrees to (i) be bound by these Official Rules and the decisions of the Judges; and (ii) release and hold harmless Facebook, Inc., ING DIRECT, its parents, subsidiaries, affiliates, distributors, advertising and promotion agencies, suppliers and all of their respective directors, officers, employees, representatives and agents (including, without limitation, the Judges) from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from entrant’s and/or prize winner’s participation in the Contest and/or acceptance and use of the prize.

  5. PRIZE WINNERS: The names of the winners will be posted on the Contest website.
